Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and NestFund Pty Ltd (“NestFund”, “we”, “us”, “our”). They govern your use of the NestFund website at nestfund.app and the NestFund app at my.nestfund.app (together, the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

You may use NestFund only if:

• You are at least 18 years old
• You are capable of forming a binding contract under applicable law
• Your use does not violate any law or regulation in your jurisdiction

By using the Service, you confirm that you meet these requirements.

You must provide accurate information when creating your account and keep it up to date. You are responsible for:

• Keeping your password secure and not sharing it with anyone
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorised access at privacy@nestfund.app

We reserve the right to suspend or terminate accounts that are found to be inaccurate, fraudulent, or in violation of these Terms.

NestFund provides tools to help you track your personal net worth, income, expenses, savings goals, and budgets. The data displayed is based solely on what you enter. We do not connect to your bank accounts or verify any financial information you provide.

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may update, change, or discontinue features at any time. Where we make material changes, we will give reasonable notice where practicable.

NestFund is a tracking and organisation tool only. We are not a financial services provider and are not licensed to provide financial product advice under the Corporations Act 2001 (Cth) or any equivalent legislation.

Nothing in the Service should be relied upon to make financial, investment, tax, legal, or any other decisions. Net worth figures, budget recommendations, and goal projections are mathematical calculations based on your own inputs — they are not predictions or guarantees.

You use the Service entirely at your own risk. We strongly recommend consulting a licensed financial adviser for advice tailored to your personal situation.

NestFund offers a free tier and optional paid plans. If you subscribe to a paid plan:

• Payment is processed by Stripe. By subscribing, you also agree to Stripe's terms (stripe.com/au/legal/consumer).
• Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan).
• You may cancel at any time from Settings → Plan & Billing. Cancellation takes effect at the end of your current billing period — you retain access until then.
• We do not offer refunds for partial billing periods, except where required by Australian Consumer Law.
• We reserve the right to change pricing. We will give you at least 30 days' notice before any price increase takes effect on your existing subscription.

You own the data you enter into NestFund. We do not claim any intellectual property rights over your financial information.

You can export your data at any time from Settings → Export Data (available on paid plans). You can permanently delete your account and all associated data from Settings → Delete Account.

How we collect, store, and protect your data is described in our Privacy Policy, which forms part of these Terms.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service or another user's account
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use automated scripts or bots to access the Service
• Resell or commercially exploit the Service without our written consent
• Upload or transmit any malware, viruses, or malicious code

We may suspend or terminate your account immediately if we reasonably believe you have violated these restrictions.

The NestFund name, logo, app design, and all content we create (excluding your data) are owned by NestFund Pty Ltd and protected by Australian and international intellectual property laws. You may not copy, reproduce, or create derivative works from any part of the Service without our written permission.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be error-free, uninterrupted, or that any data you enter will be stored without loss.

Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

To the maximum extent permitted by law, NestFund Pty Ltd and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service, including loss of data, loss of profits, or financial decisions made in reliance on information displayed in the app.

Where liability cannot be excluded under Australian Consumer Law, our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim (or $100 AUD if you are on a free plan).

You may stop using the Service and delete your account at any time from Settings → Delete Account.

We may suspend or terminate your access at any time if you breach these Terms, or for operational reasons with reasonable notice where practicable. If we terminate your account without cause, we will provide a pro-rata refund of any prepaid subscription fees.

Sections 5 (Not financial advice), 9 (Intellectual property), 10 (Disclaimers), and 11 (Limitation of liability) survive termination.

We may update these Terms from time to time. If we make material changes, we will:

• Display a notice inside the NestFund app the next time you log in
• Update the "Last updated" date at the top of this page

Continuing to use the Service after updated Terms take effect means you accept the changes. If you do not agree, you should delete your account before the new Terms take effect.
